Este trabalho é uma investigação sobre os conceitos de espaço presentes tanto no livro IV da Física de Aristóteles, bem como no Livro 1, parte 2, do Tratado da Natureza Humana de David Hume. Nosso ponto de partida são os paradoxos de Zenão. Sabemos que Aristóteles debate diretamente com Zenão no livro IV da Física, enquanto Hume, no Tratado da Natureza Humana discute com a posição de Zenão acerca do espaço renovada por Bayle. Tendo isto em vista, o principal objetivo (...) deste trabalho é o de expor como Aristóteles enfrenta o paradoxo proposto por Zenão acerca do lugar, e como Hume enfrentou o paradoxo proposto por Bayle sobre a constituição do espaço, através de uma apropriação do método de Zenão. The first work that René Descartes wrote was the Compendium Musicæ in 1618, this was his first experiment with the future cartesian method. As a work of youth, the author must have studied music in your education, mainly in the college of La Flèche. Conventionally, the work of Gioseffo Zarlino had been considered the main source, because was cited in the Compendium. Since the text starts with music´s definition and eight propositions, about which the rest of work was developed; check (...) the way that them appear in other treatises of the time could help to deduce the possible musical sources that the author used.This dissertation starts with a necessary reconstitution of philosophical and musical context of the epoch, followed by an analysis of jesuits conceptions of knowledge and music. In this way, it can be considered what motivated the author to write about music, as his the debates. In resemblance to his mature work, the text proposes a methodological turn that is only perceived with the context of the time in mind. After an interpretation of the definition of the music and the eight propositions, it could be possible compare with the others works form the epoch to verify his musical sources. With this process, it could evidence the influence of Aristotle, Aristoxenus, Jean de Murs, Pontus de Tyard, Gioseffo Zarlino and Francisco de Salinas. (shrink)

The philosopher René Descartes wrote the Compendium musicæ in 1618. Even though he was not known for his music production, he maintained a long correspondence around the subject in dialogue with Marin Mersenne, Constantjin Huygens, Isaac Beeckman and Joan-Albert Ban. However, his musical propositions appear as a marginal subject in his intellectual journey. To understand whether the musical theme relates to the development of his ideas, first, the organization of his correspondence about music and the citations to it in his (...) works was necessary, either in smaller texts or in the works published by the author. We analyzed the hypotheses about the forgetfulness of music in studies about the development of Descartes´ ideas. With these materials, we analyzed and historically contextualized the trajectory of the author's musical conceptions with the development of his main themes. Thus, it is possible to verify Descartes' musical dialogues with his own work and with his historical context. (shrink)

A evidência textual primária confirma que Schopenhauer estava ciente da adoção generalizada do confinamento solitário no sistema penitenciário americano e alguns de seus efeitos prejudiciais. Ele entende sua perniciosidade no que diz respeito ao tédio, fenômeno pelo qual é conhecido por ter nele pensado e analisado extensivamente. Neste artigo, eu interpreto o relato de Schopenhauer sobre o tédio e sua relação com o confinamento solitário. Defendo Schopenhauer contra a objeção de que os casos de confinamento servem apenas para ilustrar a (...) inadequação geral de sua explicação do tédio como a falta de coisas para se querer. Esta defesa chega à conclusão de que, ao contrário, alguém pode muito bem sofrer da falta de coisas para querer como resultado direto de estar confinado; e que o tédio, entendido como a privação de vontade — fenômeno que sugiro poder ser chamado de privação conativa — faz uma contribuição esclarecedora para a nossa compreensão teórica da nocividade do confinamento solitário. We present a module based criterion, i.e. a sufficient condition based on the absolute value of the matrix coefficients, for the convergence of Gauss–Seidel method (GSM) for a square system of linear algebraic equations, the Generalized Line Criterion (GLC). We prove GLC to be the “most general” module based criterion and derive, as GLC corollaries, some previously know and also some new criteria for GSM convergence. Although far more general than the previously known results, the proof of GLC is simpler. (...) RESUMO A Transferência de Embrião (TE) em bovinos se trata de uma técnica mundialmente disseminada com objetivo de aumentar a capacidade reprodutiva da fêmea. Mantém vínculo direto com outras técnicas das biotecnologias da reprodução, como, a Ovum Pick-Up (OPU), Produção In Vitro e In Vivo de embriões (PIVE) e Transferência de Embrião em Tempo Fixo (TETF), sendo estas, técnicas que fazem parte de um processo, que vai desde a seleção de doadoras, passando pelo preparo dos embriões até sua inovulação em (...) receptoras criteriosamente selecionadas. Com seu avanço, várias tecnologias de manejo vêm sendo implantadas: formas no transporte de embriões, protocolos de sincronização de doadoras e receptoras, e protocolos de recuperação de oócitos para produção de embriões. Isto infundiu a tecnologia, porém, os investimentos previstos para a produção de um animal de alto mérito genético limita sua utilização. Contudo, esta análise abordou avanços tecnológicos essenciais para o sucesso da TE, incluindo novos protocolos, sexagem de embriões, além do uso de embriões congelados Direct Transfer (DT) e vitrificados. No entanto, é claro que o sucesso do procedimento está no processo como um todo, em destaque ressalta-se que é de grande valia que o profissional apto a executar a técnica esteja sempre preparado e atualizado garantindo qualidade, eficiência e sustentabilidade na pecuária. Esta revisão foi desenvolvida com o propósito de adquirir conhecimento teórico, de forma detalhada e crítica, nas técnicas e procedimentos de Transferência de Embriões em bovinos, incluindo a colheita, manipulação e implantação de embriões. Palavras-chaves: Bovino, doadora, embrião, receptora. ABSTRACT Embryo Transfer (ET) in cattle is a globally widespread technique aimed at enhancing the reproductive capacity of females. It is closely linked to other techniques in reproductive biotechnologies, such as Ovum Pick-Up (OPU), In Vitro and In Vivo Embryo Production (PIVE), and Timed Embryo Transfer (TET), all of which are part of a process that ranges from donor selection, through embryo preparation, to their inoculation into carefully chosen recipients. With its advancement, various management technologies have been implemented: including methods for embryo transport, synchronization protocols for donors and recipients, and oocyte recovery protocols for embryo production. Although technology has been infused, the anticipated investments for producing animals of high genetic merit limit its widespread use. However, this analysis addressed essential technological advances for the success of ET, including new protocols, embryo sexing, as well as the use of frozen-thawed (DT) and vitrified embryos. Nevertheless, it is clear that the success of the procedure lies in the entire process. Notably, it emphasizes the significant value of having a qualified professional who is always prepared and updated to ensure quality, efficiency, and sustainability in livestock farming. This literary review was developed with the purpose of acquiring theoretical knowledge, in a detailed and critical way, on the techniques and procedures of Embryo Transfer in cattle, including the collection, manipulation and implantation of embryos. Esse volume consiste em traduções de verbetes da Enciclopédia Stanford de Filosofia que dizem respeito à Filosofia das Emoções. Trata-se de um volume de orientação história, que visa desfazer o mito de que emoções foram objetos menores de análise filosófica antes da contemporaneidade, resgatando assim a grande riqueza de teorias e reflexões sobre emoções e afetos na filosofia antiga, medieval, renascentista, moderna e indiana.

Na peça Huis Clos (Entre quatro paredes), acompanhamos três personagens: Garcin, Inès e Estelle, que são trancados juntos em uma sala após suas mortes. À espera de enxofre, fogo e tortura física no além-vida, surpreendem-se ao notar que o suposto inferno é, na verdade, a simples convivência constante com o outro. Neste cenário, por meio de uma análise das características desse inferno criado por Sartre, buscamos entender questões caras para a filosofia do autor, em especial, o papel do olhar enquanto (...) instrumento de reconhecimento e as dimensões conflituosas da existência do outro. ABSTRACT The disparity in the venezuelan demographic transition is a fact known by experts. On this setting, there are four municipalities in Falcón State with a high elder population, one of them is Tocópero. This research had as general objectives to study the estimations of demographic risks and the social politics for elders, people who are 75 and more, from Tocópero Municipality, considering that specialists indicate that, once the demographic oldness has arrived, it is important to study thoroughly the elder (...) population in order to design relevant politics and programs, taking into consideration that it is a vulnerable group. It was an exploratory and descriptive study, with a field-no experimental-transectional design. The sample was intentional. Structured interviews and questionnaires were applied to elders and municipal officials. The data processing was carried out by using quantitative methods. The conclusions indicated that the elder population in Tocópero Municipality had a marked female tendency. In general terms, the adverse effects associated to the estimations of demographic risk were not present in the studied sample. There was no relation between the demographic reality of this municipality and the social politics and programs implemented. The programs concentrated the elder and suppressed the intergenerational contact; the centralism was the key element to understand the present politics of the Venezuelan state towards the oldness. The demographic oldness of this municipality was determined by the way in which the birth of the municipality was approved. (shrink)

In 2017, the neologism “Aporophobia”, developed by the Spanish philosopher Adela Cortina, professor of Moral Philosophy at the University of Valencia, was elected as the word of the year. Such a concept was developed by Cortina in order to highlight what she calls a systemic rejection towards poverty and people without resources. Our goal in this paper is to explain the concept of aporophobia and the argumentative premises used by the philosopher to validate it, as well as to use contemporary (...) authors to reflect on the ways in which we can visualize and think such condition in our societies and contemporaneity. Is ruling out the possibility that one is dreaming a requirement for a knowledge claim? In “Philosophical Scepticism and Everyday Life” (1984), Barry Stroud defends that it is. In “Others Minds” (1970), John Austin says it is not. In his defense, Stroud appeals to a conception of objectivity deeply rooted in us and with which our concept of knowledge is intertwined. Austin appeals to a detailed account of our scientific and everyday practices of knowledge attribution. Stroud responds that what Austin (...) says about those practices is correct in relation to the appropriateness of making knowledge claims, but that the skeptic is interested in the truth of those claims. In this paper, we argue that Stroud’s defense of the alleged requirement smuggles in a commitment to a kind of internalism, which asserts that the perceptual justification available to us can be characterized independently of the circumstances in which we find ourselves. In our reading of Austin, especially of Sense & Sensibilia, he rejects that kind of internalism by an implicit commitment to what is called today a “disjunctive” view of perception. Austin says that objectivity is an aspect of knowledge, and his disjunctivism is part of an explanation of why the alleged requirement is not necessary for a knowledge claim. Since both Stroud and Austin are committed to the objectivity of knowledge, Stroud may ask which view of perceptual knowledge is correct, whether the internalist or the disjunctive. We argue that by paying closer attention to what Austin says about our practices of knowledge attribution, one can see more clearly that it is grounded not only on a conception of objectivity, but also on a conception of ourselves as information agents, a conception that is as deeply rooted as that of the objectivity of knowledge. This gives us moral and practical reasons to favor the disjunctive view of perception. (shrink)

The main aim of this article is to reflect on the impact of biases related to artificial intelligence (AI) systems developed to tackle issues arising from the COVID-19 pandemic, with special focus on those developed for triage and risk prediction. A secondary aim is to review assessment tools that have been developed to prevent biases in AI systems. In addition, we provide a conceptual clarification for some terms related to biases in this particular context. We focus mainly on nonracial biases (...) that may be less considered when addressing biases in AI systems in the existing literature. In the manuscript, we found that the existence of bias in AI systems used for COVID-19 can result in algorithmic justice and that the legal frameworks and strategies developed to prevent the apparition of bias have failed to adequately consider social determinants of health. Finally, we make some recommendations on how to include more diverse professional profiles in order to develop AI systems that increase the epistemic diversity needed to tackle AI biases during the COVID-19 pandemic and beyond. RESUMO A alimentação é o fator que mais onera um sistema de produção animal. Assim, a utilização de diferentes estratégias de alimentação dos animais ainda é o grande desafio da nutrição animal, principalmente, levando em consideração as exigências nutricionais de diferentes categorias de ruminantes, em especial bovinos em regiões tropicais, haja vista que a sazonalidade na produção de forragens afeta diretamente a produção bovina, promovendo inadequação no atendimento das exigências nutricionais dos animais principalmente em minerais e vitaminas. Uma alimentação que (...) não atenda as exigências nutricionais dos ruminantes gera prejuízos no sistema de produção, além de, em casos mais graves, ocasionar a perda do animal. Estudos que abordam o efeito e a importância de vitaminas e minerais na nutrição bovina são escassos e necessários. Recentemente a National Research Council (NRC) apresentou novos registros das exigências nutricionais das vitaminas e minerais. Essas alterações proporcionam um impacto econômico significativo em relação à nutrição animal. Thus, the use of different animal feeding strategies is still the great challenge of animal nutrition, taking into account the nutritional requirements of different categories of ruminants, especially cattle in tropical regions, given that seasonality in forage production directly affects cattle production, promoting inadequacy in meeting the nutritional requirements of animals, mainly in minerals and vitamins. A diet that does not meet the nutritional requirements of ruminants generates losses in the production system, in addition to, in more serious cases, causing the loss of the animal. Studies that address the effect and importance of vitamins and minerals in bovine nutrition are scarce and necessary. Recently the National Research Council (NRC) presented new records of the nutritional requirements of vitamins and minerals. These changes provide a significant economic impact on animal nutrition. This paper argues that the normative character of our unreflective situated behaviour is not factual. We highlight a problematic assumption shared by the two most influential trends in contemporary philosophy of cognitive science, reductionism and enactivism. Our intentional, normative explanations are referential, descriptive or factual. Underneath this assumption lies the idea that only facts can make true or false our attributions of cognitive, mental and agential abilities. We will argue against this view by describing the main features and problems of (...) reductionism and enactivism and then we will offer two arguments against this shared factualist assumption: (1) normative vocabulary is ineliminable if we want a complete explanation of our situated practices; and (2) the factualist assumption is a species of the is-ought fallacy. Finally, we will claim that a folk psychological explanation of our normative practices is fully compatible with ontological naturalism when such descriptivist or factualist assumption is rejected. McDowell’s minimal empiricism holds that experience, understood as providing conceptually articulated contents, plays a role in the justification of our beliefs. We question this idea by contrasting the role of perceptual experience in moral and non-moral judgments and conclude that experience per se is irrelevant in the former case and should also be so in the latter one: only with the help of adequate beliefs experience can provide a connection with the world. In this paper, we offer a criticism, inspired by Wittgenstein’s rule-following considerations, of the enactivist account of perception and action. We start by setting up a non-descriptivist naturalism regarding the mind and continue by defining enactivism and exploring its more attractive theoretical features. We then proceed to analyse its proposal to understand normativity non-socially. We argue that such a thesis is ultimately committed to the problematic idea that normative practices can be understood as private and factual. Finally, we offer a (...) characterization of normativity as an essentially social phenomenon and apply our criticisms to other approaches that share commitments with enactivism. (shrink)

nos últimos anos, John McDowell tem proposto uma concepção de filosofia em que o objetivo da disciplina não é oferecer teses substanciais, mas antes revelar modos de pensar e premissas ocultas que estão na base da filosofia construtiva. Esta visão terapêutica tem sido chamada ‘quietismo’ e deve muito a algumas idéias favoritas de Wittgenstein ao longo de toda a sua vida. No entanto, a obra de Wittgenstein (e, talvez, também a de McDowell) parece oscilar entre duas compreensões de quietismo: pode-se (...) ser quietista por não macular aquilo que é mais importante com discussões explícitas ou pode-se ser quietista por não ter nada a dizer. Argumentaremos que o segundo tipo do quietismo não implica recusar em se ocupar com a filosofia do passado, nem tampouco adotar uma atitude contemplativa. A concentração sobre o particular, em ética tanto quanto em qualquer outra área da filosofia, é suficiente para minar as ambições universalistas da filosofia tradicional e descortinar um aumento na ação filosófica. This article discusses the place that the concept of rhythm occupies within Gilles Deleuze’s phi- losophy. I present a panorama of different ways to conceptualize thought throughout Deleuze’s writings from 1960’s to 1990’s, emphasizing the discussion about the threshold of thought. In the writings in partnership with Félix Guattari, Deleuze understand thought as an act of confronting chaos, what makes the problem of consistency a point of extreme relevance within his philosophical system. In this framework, the concept of thought is (...) described as a tension between consistency and infinite speed (chaos). In order to elaborate this concept of thought, Deleuze resumes his con- ceptualization of the three syntheses of the time and formulates with Guattari the concept of re- frain. I will show that the refrain is at the axis of an epistemological shift in the whole program of transcendental philosophy, by affirming a necessarily heterogeneous and aberrant Time, which features the concept of rhythm as the genetic element of difference. Within this conceptual frame- work, I follow the authors’ suggestion that the logic of schizoanalysis is analogous to the logic of subtractive sound synthesis. The main goal is to demonstrate that rhythm is at the core of Deleu- zian concept of difference and sound is at the core of Deleuzian concept of thought. (shrink)

This article discusses the precariousness of labor relations in Brazil, focusing on the concept of “Uberization”. To this end, an analysis is made of the Brazilian sociological reality concern-ing formal and informal work relationships, seeking to understand the said problem and its implications for the social subjects directly involved with this new form of work. Thus, a map-ping of specialized theoretical production is used to account for the discussion of recent transformations in capitalism and modes of production in a critical (...) and current way. In this paper we challenge the notion of ‘normativity’ used by some enactive approaches to cognition. We define some varieties of enactivism and their assumptions and make explicit the reasoning behind the co-emergence of individuality and normativity. Then we argue that appealing to dispositions for explaining some living processes can be more illuminating than claiming that all such processes are normative. For this purpose, we will present some considerations, inspired by Wittgenstein, regarding norm-establishing and norm-following and show that attributions of (...) normativity to non-social agents are deeply paradoxical. The main conclusions of our discussion are: (1) circular and internal explanations centred on the stability of living systems are insufficient to account for processes where the environment plays an important role, such as adaptation. Enactivism is not an explanatory alternative to evolutionary biology but needs it as a complement to accounts focused on the internal self-assembly of organisms; (2) though we share enactivism’s anti-representational spirit, we argue that ecological psychology can offer a better account of perception. Richard Moran has argued, convincingly, in favour of the idea that there must be more than one path to access our own mental contents. The existence of those routes, one first-personal—through avowal—the other third-personal—no different to the one used to ascribe mental states to other people and to interpret their actions—is intimately connected to our capacity to respond to norms. Moran’s account allows for conflicts between first personal and third personal authorities over my own beliefs; this enable some instances of (...) Moore-paradoxical cases to be meaningful. In this paper we reflect on the consequences of this view for the acquisition of beliefs, and argue that, as in the moral case, excessive concentration on a thirdpersonal understanding of thought undermines the very idea of being directed to the world and of being capable to fully own our own beliefs. We suggest that maybe too much attention to epistemic virtues or tojustification is misdirected and could produce beliefs that are themself not first-personal enough. (shrink)

Schaffer (2010) argues that the internal relatedness of all things, no matter how it is conceived, entails priority monism. He claims that a sufficiently pervasive internal relation among objects implies the priority of the whole, understood as a concrete object. This paper shows that at least in the case of an internal relatedness of all things conceived in terms of physical intentionality - one way to understand dispositions - priority monism not only doesn't follow but also is precluded. We conclude (...) that the internal relatedness of all things is compatible with several different ontologies (including varieties of pluralism) but entails nothing concerning dependence between concrete objects. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Die Forschung hat bislang entweder bemängelt, dass Nietzsches Philosophie ein Begriff von szialer Gerechtigkeit fehlt oder had einen solchen kaum in den Blick bekommen. Im Gegensatz dazu argumentiert der Aufsatz dafür, dass der sozialen Gerechtigkeit in Nietzsches politischem Denken eine zentrale Rolle zukommt. On the contrary, the essay argues that social justice plays an important role in Nietzsche's political thinking. It shows that his conception of justice is modelled after Plato's antique concept of political justice. The main thesis of the essay is that this conception is embodied in Nietzsche's notion of a well-ordered state or society. An additional thesis concerns the anthropological basis of what Nietzsche holds to be a just social order. Simultaneamente, desta-cam-se os голоl ou valores universais patenteados no texto de Vieira e que constituem a base da (...) teoria da argumentação de Oswald Ducrot. \\\ In the "Sermon for the good success of the Portuguese army against Holland's", Vieira displays all his gifts as an uncommon writer, an excellent theologian, a non negligeable jurist, a convinced humanist, and, above all, a wholehearted patriot. This essay is an attempt to put in evidence the preacher's argumentative power, on the basis of Chaïm Perelman's considerations on Rethoric as "a speech that aims to convince or persuade". En la literatura jurídico penal, el arrepentimiento cobra relevancia en un lugar específico: la condena, más precisamente, en la determinación de la pena del sujeto que ha sido encontrado responsable por la comisión de un delito y que, a su vez, se encuentra arrepentido por su accionar. Desde la concepción comunicativa del castigo, en este trabajo contestaré las siguientes preguntas: ¿El arrepentimiento significa un menor reproche penal o es indiferente para la determinación de la pena? en caso de que implique (...) un acercamiento al castigo mínimo establecido en la legislación ¿Cuándo es razonable que esto suceda? In this paper I argue that the idea of human dignity has a precise and philosophically relevant sense. Following recent works,we can find some important clues in the long history of the term.Traditionally, dignity conveys the idea of a high and honourable position in a hierarchical order, either in society or in nature. At first glance, nothing may seem more contrary to the contemporary conception of human dignity, especially in regard to human rights.However,an account of dignity as high rank provides (...) an illuminating perspective on the role it plays in the egalitarian discourse of human rights. In order to preserve that relational sense regarding human dignity, we can use the notion of moral status, towhich somemoral philosophers have paid attention in recent years.I explore the possibilities of the idea of moral status to better understand the idea of human dignity and its close relationship with human rights. La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. Um der Komplexität und den Interdependenzen dieser Systeme gerecht zu werden, ist auf verschiedenste Fachbereiche und deren Zugänge zurückzugreifen. Diese bilden die Grundlage, um Lernende zu befähigen, sich selbstbestimmt und emanzipiert mit den gesellschaftspolitischen Fragen des 21. Jahrhunderts auseinanderzusetzen. Basierend auf den Beiträgen dieses Sammelbandes skizzieren (...) wir grundlegende Aspekte einer Politischen Bildung für die digitale Öffentlichkeit. (shrink)

It is common to criticize the idea of objectivity by claiming that we cannot make sense of any cognitive contact with the world that is not constituted by the very materials of our thinking, and to conclude that the idea must be abandoned and that the world is ‘well lost’. We resist this conclusion and argue for a notion of objectivity that places its source within the domain of thoughts by proposing a conception of facts, akin to McDowell’s, as thinkable (...) while independent of any act of thinking. Dieser Beitrag greift das Phänomen Fake News auf und plädiert für einen analytischen Zugang zur Thematik. Zunächst grenzt er den Begriff der Fake News von anderen Phänomenen ab. Er zeigt auf, dass der Begriff nicht nur keinen analytischen Mehrwert bietet, sondern dass er die eigentlichen Probleme verschleiert und als Propagandabegriff u.a. Verwendung findet, um Zensur zu rechtfertigen und die Gegenseite zu delegitimieren. Trotzdem sollte die Politische Bildung nicht vollkommen auf den Begriff verzichten. Versteht man Fake News als einen fließenden Signifikant (...) in hegemonischen Projekten, erlaubt dies den Zugriff auf die politische Dimension von Desinformation. Fake News als politischer Kampfbegriff lässt sich darüber hinaus als einen Angriff auf die Autorität der Leitmedien interpretieren. Der Autor geht im Anschluss sowohl auf die inhaltliche als auch auf die formelle Dimension dieses Angriffs ein. Darauf basierend erarbeitet er einen Vorschlag, wie Fake News auf analytischer Basis in der Politischen Bildung behandelt werden könnten. (shrink)

La obra de Lévinas propone asumir la ética como Filosofía Primera. Allí convergen dos fuentes de inspiración filosófica, el pensamiento judío y la fenomenología, y la experiencia histórica de persecución, violencia y desconocimiento del otro que exigió a Lévinas criticar el totalitarismo ontológico griego con el propósito de hacer justicia a la Alteridad y dar primacía así a la Responsabilidad para con el Otro sobre la Libertad autónoma del Yo. Luego, el autor retorna la crítica de Lévinas a la fenomenología (...) de la conciencia y a la ontología hermenéutica de Heidegger, con la que Occidente lleva a término su limitada opción por el conocimiento y la manifestación del Ser. Rubio y Lévinas, en tercer lugar, señalan hacia una hermenéutica encarnada de nuestras relaciones con el Otro, a una reivindicación de la antropología filosófica que recupere el Sentido desde el Otro. Finalmente, el autor se refiere al terna de la muerte en Lévinas, y subraya, en relación con la desaparición del maestro Rubio que, nuestro adiós a él, significa el 'ante Dios' de todas nuestras relaciones no tematizables con el Otro y antes que todo.
